Don’t even think about it.
For one privacy is a big deal. Since we are dealing with health insurance and employees' health things could get pretty uncomfortable for everyone involved. Then there’s HIPAA, which is another layer of protection for employees’ private health information. It’s also time-consuming for business owners to keep up with the medical receipts, maintain all the health information in a secure way, and handle the paperwork that comes with it.
If you have a misstep, civil penalties can range from $100 to $50,000 per incident with no jail time to more serious offenses resulting in up to $250,000 in fines and 10 years in prison, especially if information was taken under false pretenses or disclosed on purpose.

The great part about QSEHRA is that the plan can go into effect whenever you want it to. Just pick a start date. It’s as simple as that. For employees, they will have a special enrollment period to purchase health plans on the individual market when the QSEHRA begins, and then will renew or select a new plan each Open Enrollment after that (November 1–December 15 in most states).
Great question. QSEHRA can replace a group health plan but many small business owners use it as an on-ramp to offering health benefits. A rule to remember, however, is that QSEHRA cannot be offered in addition to a group health plan.
To determine if your company is eligible for QSEHRA, the only eligibility requirements are that you are, in fact, a small business (less than 50 full time equivalent employees) and do not offer a group health plan. For owner eligibility where you can participate in the plan, it would depend on how your business is set up.
There are a few QSEHRA reimbursement policies to remember. The most important one is that employees must be treated fairly in terms of their reimbursement amounts. The reimbursements are subject to annual maximums and become available to employees on a monthly basis. Unused funds stay with the employer and the reimbursements are funded solely by the employer, meaning employees can’t contribute. If this sounds confusing, don’t worry. A QSEHRA third party administrator will help you stay on track.
Employees can use QSHERA funds to pay the premium for the individual health insurance plan they choose through the marketplace, a direct insurer, or Medicare. This premium qualifies for small business health reimbursement as well as the following medical expenses:
