This Privacy Policy (our “Privacy Policy”) describes the types of information we may collect from you or that you may provide when you visit www.takecommandhealth.com (“Website”) or when you use the Take Command Insurance Agency, Inc. (doing business as Take Command Health) services, products or insurance plans offered through the Website (collectively, “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • on our Website;
  • in email, text, and other electronic messages between you and our Website; and
  • when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • us offline or through any other means, including on any other Services operated by Take Command Health or any third-party (including our affiliates and subsidiaries) unless mentioned within this policy;
  • us or any of our affiliates or subsidiaries related to your or any other individual’s employment or potential employment with us; or
  • any third party not mentioned in this policy including through any application or content (including advertising) that may link to or be accessible from or the Website.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using our Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

Children Under the Age of 18

Parents and legal guardians of children under 18 years of age may provide us with Personal Data for those children to obtain Services. However, no one under age 18 may directly provide any information to or on the Services. We do not knowingly collect Personal Data directly from children under 18. If you are under 18, do not use or provide any information on our Services or on or through any of its features, including your name, address, telephone number, or email address. If we learn we have collected or received Personal Data directly from a child under 18, we will delete that information. HIPAA Protected Health

Take Command Health is a licensed Insurance Agency that operates under Texas Department of Insurance License #1955535. See additional licensing information here.

Take Command Health is regulated by the Health Insurance Portability and Accountability Act and its implementing regulations (collectively, “HIPAA”). Accordingly, Take Command Health will use, disclose, and safeguard your Personal Data described in this Privacy Policy in accordance with HIPAA to the extent applicable.

Information We Collect About You and How We Collect It

Throughout this Privacy Policy, the term “Personal Data” means any information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or device. However, Personal Data does not include any deidentified or aggregated information.

Generally

We collect Personal Data from various sources, including:

  • directly from you when you provide it to us;
  • automatically as you navigate through the Website;
  • information that we create about you as you use our Services; and
  • from your employer, health plan, or other authorized third parties.

Information You Provide to Us

We collect the following types of Personal Data directly from you when you access or use our Services: real name, alias, postal address, online identifier, unique personal identifier, email address, social security number, financial information, insurance information, employment information, signature, medical information, medical conditions, health data, gender, gender identity, pregnancy status, marital status, telephone number, account name, age, birthdate, color, race, sex/sex life, marital status and any other identifier by which you may be contacted online or offline. In addition, we also collect other types of information that you may provide when you fill out a form or through your correspondence with us.

The Personal Data we collect on or through our Services through:

  • information that you provide by filling in forms on our Services. This includes information provided at the time of registering to use our Services, subscribing to our service, or requesting further services. We may also ask you for information when you report a problem with our Services;
  • records and copies of your correspondence (including email addresses), if you contact us;
  • your responses to surveys that we may ask you to complete for research purposes; and
  • your search queries on the Website.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain Personal Data about your interaction with our Services, including information about your equipment, browsing actions, and patterns:

The information we collect automatically may include Personal Data, or we may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service by enabling us to:

Some content or applications, including advertisements, on the Services are served by third-parties, including advertisers, ad networks and servers, content providers, analytics providers, social media companies, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your Personal Data or they may collect information, including Personal Data, about your online activities over time and across different Services and other online services. We use the following technologies to automatically collect data:

  • Google Analytics. We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of our Website. Google Analytics uses cookies, to help our Website analyze how users use our Services.   • Hotjar. Our Website uses Hotjar’s services, a third-party service provider, which helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and enables us to build and maintain our Website and Services with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device's IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user.   • Hubspot. We use Hubspot, a service provided by Hubspot, Inc. Hubspot uses web beacons and cookies stored on your computer and enabled to allow us to analyze the use of our Websites. HubSpot evaluates the collected information (e.g., IP address, geographical location, type of browser, duration of the visit, and pages accessed) on our behalf in order to generate reports on the visit and the pages visited. If you generally do not want HubSpot to collect data, you can prevent cookies from being stored at any time using your browser settings.
  • Stripe. We use Stripe as our payment processor. In order to allow Stripe to function properly, a cookie is stored on your browser, which assists Stripe in detecting and preventing fraud.   • Intercom. We use Intercom to provide us with customer service functionality, including support and ticketing services.   • Other third party tools. We use other third party tools which allow us to track the performance of our Website. These tools provide us with information about errors, app and website performance, and other technical details we may use to improve our Website and/or the Services. We do not control these third parties’ tracking technologies or how they may be used. How We Use Your Information

We may use information that we collect about you or that you provide to us, including any Personal Data:

  • to provide and personalize our Services and its content to you;
  • to provide you with information, products, or services that you request from us;
  • to process your requests, purchases, transactions, and payments and prevent transactional fraud;
  • to administer upcoming events, updates, sweepstakes, promotions, and other contests;
  • to support, develop, troubleshoot, and debug our Website, products, and services;
  • to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses;
  • to personalize your Website experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through via email or text message (with your consent, where required by law);

Disclosure of Your Information

We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Policy. However, we may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

The Personal Data that we collect or that you provide as described in this Privacy Policy may be disclosed:

  • to your desired insurance company in order for your policy to be issued to you;
  • to contractors, business partners, service providers, and other third-parties we use to support our business and who are bound by contractual obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them (for example, Stripe and Dwolla). These entities may provide IT services, infrastructure support services, payment processing services, and other services;
  • to fulfill the purpose for which you provide it;
  • for any other purpose disclosed by us when you provide the information; and
  • with your consent.

We may also disclose your Personal Data:

  • to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our users are among the assets transferred;
  • to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; and
  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Take Command Health, our customers, or others.

Choices About How We Use and Disclose Your Information

We do not offer you choices on how you can opt out of certain uses and sharing of your Personal Data at this time. As a general rule, you cannot opt out of our collection, use and sharing of Personal Data to the extent it is necessary to provide the Services or related Services, features and functionality to you.

We do not control the collection and use of your information collected by third parties described above in Disclosure of Your Information. When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.

Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. Our Website is not currently set up to respond to those signals.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Accessing, Correcting, and Deleting Your Personal Data

You can review and change your Personal Data by accessing our Website form, calling us at the number listed at the bottom of this policy, or by sending us an email at notices@takecommandhealth.com to request access to or correct any Personal Data that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have taken steps and implemented administrative, technical, and physical safeguards designed to protect against the risk of accidental, intentional, unlawful, or unauthorized access, alteration, destruction, disclosure, or use. The Internet is not 100% secure and we cannot guarantee the security of information transmitted through the Internet. Where you have been given or you have chosen a password, it is your responsibility to keep this password confidential.

The sharing and disclosing of information via the internet is not completely secure. We strive to use best practices and industry standard security measures and tools to protect your data. However, we cannot guarantee the security of Personal Data transmitted to, on, or through our Services. Any transmission of Personal Data is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on our Platform, in your operating system, or mobile device.

Who May Use Our Services?

Take Command Health operates subject to state and federal regulations, and the Services may not be available in your state. You represent that you are not a person barred from enrolling for or receiving the Services under the laws of the United States or other applicable jurisdictions in which 

you may be located. Access to and use of the Services is limited exclusively to users located in states within the United States where the Services is available. The Services are not available to users located outside the United States. Accessing the Services from jurisdictions where content is illegal, or where we do not offer the Services, is prohibited.

California’s Shine the Light Law

California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits users of our Services that are California residents and who provide Personal Data in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of Personal Data to third parties for their own direct marketing purposes. If applicable, this information would include the categories of Personal Data and the names and addresses of those businesses with which we shared your Personal Data with for the immediately prior calendar year (e.g. requests made in 2023 will receive information regarding such activities in 2022). Changes to Our Privacy Policy

We may change this Privacy Policy at any time. We may revise this Privacy Policy from time to time by posting a modified version on our Website. If, in the Company’s sole discretion, the modifications to this Privacy Policy are material, we will provide you with reasonable notice prior to the change taking effect, either by emailing the email address associated with your account or by alerting you through the Service and/or Website. The date this Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Services and this Privacy Policy to check for any changes.

Your continued use of our Services following the posting of changes constitutes your acceptance to such changes.
